Opinion text
SAMUEL, Judge, concurring. While I have considerable doubt as to the correctness of the majority opinion and decree, especially because the “mechanic” upon whose testimony the majority relies was not accepted by the trial court as an expert (the trial judge allowed the witness to testify because of his experience, stating he would give that testimony the weight he deemed appropriate), and because' the person who made the first inspection was not called as a witness, I respectfully concur.
