SUPREME COURT OF LOUISIANA
No. 2022-CJ-01397
CERA MARIE VITALIANO
VS.
CHRISTOPHER DAVID BLACKSTOCK
On Supervisory Writ to the Civil District Court, Parish of Orleans
PER CURIAM
Granted. Having concluded the motion to recuse was not filed timely, the
district court had authority to “deny the motion without the appointment of an ad
hoc judge.” La. Code Civ. P. art. 154(C).
Accordingly, the judgment of the district court is vaca ted insofar as it orders
a recusal hearing before an ad hoc judge. The motion to recuse is denied, and the
case is remanded to the district court for further proceedings.
