Sarelda James v. Albertsons Companies, LLC

Louisiana Court of Appeal, First Circuit · Filed July 15, 2024

The holding in the court’s own words

After conducting a de novo review of the evidence presented in this case, we conclude that plaintiff, who will bear the burden of proof at trial, failed to produce factual support sufficient to establish that there are no genuine issues of material fact as to each element of the liability of defendant, Albertson' s Companies, LLC. Accordingly, we reverse the trial court' s March 19, ruling, which granted plaintiff' s motion for partial summary judgment on liability and deny that motion.
