SUPREME COURT OF LOUISIANA
No. 2025-C-01034
MONUMENTS AND MARKERS, LLC
VS.
CITY OF NEW ORLEANS AND THE NEW ORLEANS CITY PARK
IMPROVEMENT ASSOCIATION
On Writ of Certiorari to the Court of Appeal, Fourth Circuit, Parish of Orleans
Civil
PER CURIAM
In our review of the record, we find the lower courts erred in dismissing
petitioner’s suit without allowing an opportunity to amend the petition. We
therefore grant the writ application, in part, and remand to the trial court for the
sole purpose of allowing the p etitioner an opportunity to amend to address the
lower court’s findings that the petition does not “sufficiently state[] a cause of
action.”
REVERSED, IN PART, AND REMANDED.
