SUPREME COURT OF LOUISIANA
No. 25-K-00268
STATE OF LOUISIANA
VS.
KENDALL GORDON
On Writ of Certiorari to the Court of Appeal, Fourth Circuit, Parish of Orleans
Criminal
PER CURIAM
Granted. Appellate courts review wrongful conviction compensation rulings
for manifest error. See State v. Jones, 2022-01455, p. 5 (La. 5/5/23), 362 So.3d
341, 345. In this case, the court of appeal improperly performed de novo review of
the trial court’s denial of Kendall Gordon’s petition for wrongful conviction
compensation. Accordingly, we reverse the ruling and remand the matter to the
court of appeal for reconsideration. The court shall review the trial court’s decision
for manifest error.
REVERSED AND REMANDED.
