STATE OF LOUISIANA
COURT OF APPEAL, FIRST CIRCUIT
BARBARA LEWIS NO. 2026 CW 0777
VERSUS
DEFENDANT 1 AND DEFENDANT 2 SEPTEMBER 14, 2026
In Re: State of Louisiana, through the Department of Children
and Family Services, applying for supervisory writs,
19th Judicial District Court, Parish of East Baton
Rouge, No. 749463.
BEFORE : THERIOT, GREENE, AND EDWARDS, JJ.
WRIT DENIED.
HG
BDE
Theriot, J., dissents in part and concurs in part. I find
plaintiff has failed to state a cause of action against relator,
State of Louisiana, through the Department of Children and Family
Services, for “abuse” as that term is defined by La. Ch. Code art.
603 and would grant the exception of no cause of action and dismiss
plaintiff’s claims for abuse, as defined by La. Ch. Code art. 603.
I concur in the denial of the writ in all other respects.
