STATE OF LOUISIANA
COURT OF APPEAL, FIRST CIRCUIT
IN RE: THE SUCCESSION OF NO. 2026 CW 0953
RONALD WAYNE STEWART
SEPTEMBER 1, 2026
In Re: Kirby Wayne Stewart, applying for supervisory writs,
19th Judicial District Court, Parish of East Baton
Rouge, No. 111774.
BEFORE : McCLENDON, C.J., HESTER AND MILLER, JJ.
WRIT NOT CONSIDERED. This writ application is untimely.
Relator’s notice of intent was filed on July 2, 2026, more than
thirty days after the district court issued notice of its April
17, 2026 judgment denying relator’s motion for summary judgment.
Notice of the district court’s April 17, 2026 judgment was mailed
on April 21, 2026. Although relator filed a motion for
reconsideration from the April 17, 2026 judgment, the filing of a
motion for reconsideration, which is essentially a motion for new
trial, seeking reconsideration of an interlocutory ruling cannot
interrupt the thirty-day period for filing an application for
supervisory writs established by Rule 4-3 of the Uniform Rules of
Louisiana Courts of Appeal. See Carter v. Rhea, 2001-0234 (La.
App. 4th Cir. 4/25/01), 785 So.2d 1022, 1025.
Supplementation of this writ application and/or an
application for rehearing will not be considered. Uniform Rules
of Louisiana Courts of Appeal, Rules 4-9 and 2-18.7.
