STATE OF LOUISIANA
COURT OF APPEAL, FIRST CIRCUIT
STATE OF LOUISTANA NO. 2026 KW 0720
VERSUS
KEVIN DUKES SEPTEMBER 14, 2026
In Re: Kevin Dukes, applying for supervisory writs, 19th
Judicial District Court, Parish of East Baton Rouge, No.
01-19-0491.
BEFORE : THERIOT, GREENE, AND EDWARDS, Jd.
WRIT DENIED. See the action in State v. Dukes, 2025-0647
(La. App. Ist Cir. 10/6/25), 2025 WL 2828738 (unpublished), wherein
this court reviewed the district court’s July 5, 2025 judgment on
the motion for return of seized property and return of bond.
Furthermore, in 2025 KW 0354, this court merely instructed the
district court to rule on the motion for return of property. This
instruction did not entitle relator to relief. Moreover, the
criminal district court does not have jurisdiction over
proceedings related to forfeiture of a commercial surety bond.
Accordingly, the district court properly denied the request for
return of bond. The proper manner to appeal a bail undertaking
forfeiture judgment is by civil appeal. Supplementation of this
writ application and/or an application for rehearing will not be
considered. See Uniform Rules of Louisiana Courts of Appeal, Rules
2-18.7 & 4-9. This action is final.
