STATE OF LOUISIANA
COURT OF APPEAL, FIRST CIRCUIT

STATE OF LOUISTANA NO. 2026 KW 0744

VERSUS

RENE PAGAN SEPTEMBER 10, 2026

In Re: Rene Pagan, applying for supervisory writs, 22nd
Judicial District Court, Parish of St. Tammany, No.
4685-F-2025.

BEFORE : THERIOT, GREENE, AND EDWARDS, JJ.

WRIT GRANTED. The district court’s ruling denying the
defendant’s bill of particulars is reversed. An accused shall be
adequately informed of the nature and cause of the accusation
against him. La. Const. art. I, § 13. See also La. Code Crim. P.
art. 404. The function of a bill of particulars is to inform the
defendant more specifically of the nature of the charge against
him. Although a defendant is not entitled to discover the details
of the evidence with which the State expects to prove its charge,
a defendant may seek a bill of particulars under La. Code Crim. P.
art. 484 to elicit information from the State regarding the
specifics of the crime charged. See State v. Rogers, 375 So.2d
1304, 1308 (La. 1979). The district court is ordered to instruct
the State to provide an amended response to the defendant’s bill
of particulars specifically indicating under which of the two
subsections of La. R.S. 14:62 the State is proceeding in this
case. Accordingly, this matter is remanded for further proceedings
in compliance with this ruling.
