‘HAWTHORNE, Justice (dissenting). I am in full accord with the principles of law expressed and set forth in the majority opinion. I disagree, however, with the conclusion that the facts of this case do not justify the application of those principles, and I am of the belief that the authorities relied upon by the tax collector are controlling here. I therefore respectfully dissent.
