Opinion text
McCALEB, C. J., subscribes to the ruling that Cheek is liable but dissents from the holding exonerating Fetzer, being of the view that the latter violated his fiduciary relationship with his clients in failing to disclose that his personal client, Cheek, had a secret deal to make $125,000 (of which Fetzer received $25,000) at their *31 expense. When Fetzer accepted employment from the joint ventures, his private dealings with Cheek should have ended insofar as the instant transaction was concerned. BARHAM, J., concurs in part and dissents in part with written reasons. DIXON, J., concurs as to Cheek and dissents as to Fetzer.
