La. 2012
In determining whether a punishment is grossly disproportionate to the severity of the offense or constitutes nothing more than needless *1283 infliction of pain and suffering, this Court has repeatedly emphasized that sentence review under the Louisiana constitution does not provide an appellate court with a vehicle for substituting its judgment for that of a trial judge as to what punishment is more appropriate in a given case.
