AMY, J., dissenting. I respectfully dissent from the majority. The judgment of the workers’ compensation judge indicates that it referred “reopening of the exception to the trial of the merits.” Given this lack of ruling, I would decline review of this matter as premature. Accordingly, I would remand for the workers’ compensation judge’s decision in this regard.
