Opinion text

On Motion to Dismiss. The opinion, of the court was delivered by Manning, C. J. The motion to dismiss is based on the ground that the names of the sureties to the appeal are not inserted in the body *1128 of the bond. This ground would be good, if the fact were as stated. There are two sureties, whose signatures are at the bottom of the bond, which is for one hundred dollars, and the name of one of them is inserted in the body of the bond, and that makes it good. The motion is denied.
