COVINGTON, Judge: For the reasons assigned in the case of "Toomer Electrical Company, Inc. v. Humble Oil and Refining Company et al.”, 321 So.2d 827 , the judgment of the trial court is affirmed, dismissing plaintiff’s suit at his cost. Affirmed.
