PICKETT, J., dissenting. liThe defendant has had an opportunity to be heard in the trial court. At that hearing, he had the burden of proving that his guilty plea was not knowingly and voluntarily made. The record is clear that he failed to meet that burden of proof. Therefore, his conviction should be affirmed.
