ON REHEARING In its application for Re-Hearing, Defendant-Appellee, Fidelity and Casualty Company of New York raises an issue which was not argued nor briefed before this court or the trial court in support of its motion for summary judgment. Nonetheless, this does not preclude Defendant-Appellee from raising this issue in the trial court below. Accordingly, the request for rehearing is denied.
