PER CURIAM * . Application granted. The case is remanded to the court of appeal with instructions to treat the writ application as a devolutive appeal from an appealable judgment. See e.g., Stein v. Martin, 97-0287 (La.3/27/97), 691 So.2d 674 ; see La.Code Civ. P. art. 865. KIMBALL, JOHNSON, and TRAYLOR, JJ., would deny the writ.
