HOLDRIDGE, J., concurring. hi respectfully concur. While I agree with the result reached by the majority, I believe that the trial court abused its discretion in designating the partial judgment as a final judgment. Consequently, I believe that this court lacks, appellate jurisdiction and that the appeal should have been converted into a writ application and reviewed under our supervisory jurisdiction.
