KNOLL, J., dissents. ■ 11 This pre-trial discovery issue is very problematic, and-the lower courts are. in need of clear guidance. I disagree with the majority’s decision to dispose of this most serious issue by a per curiam rather than by an authored opinion after full briefing and oral argument. Because I find it inappropriate to dispose of this case by a per curiam, I would grant and docket.
