Opinion text

O’NIELL, C. J. This is a proceeding for mandamus to reduce the amount of an appeal bond, fixed by an order of one of the judges of the civil district court. When the judge and the appellee were directed to show cause why the amount of the bond should not be reduced, the appellee consented to the reduction, and the judge ordered it. There is therefore nothing left for decision in this proceeding. The respondents are discharged from the rule, and this proceeding is dismissed.
