The opinion of the court was delivered by Nicholls, O. J. The pleadings and issues in this case are similar to those in Randall vs. Hamilton, decided this day. For the reasons therein assigned, it is ordered, adjudged and decreed that the judgment appealed from be annulled, avoided and reversed, the case reinstated and remanded for further proceedings according to law.
