BARNETTE, Judge. For the reasons assigned in our opinion this day rendered in State of Louisiana, through the Department of Highways v. Barton, et ux., 231 So.2d 403 , the judgment appealed in this case, State of Louisiana, through the Department of Highways v. Tate, is affirmed. Affirmed.
