FRUGÉ, Judge. For the reasons assigned in the companion case of Refractory Construction, Inc. v. Cities Service Oil Company, et al., 278 So.2d 510 (La.App. 3rd Cir., 1973) our docket number 4183, the judgment of the District Court is affirmed. Affirmed.
