FRUGÉ, Judge ad hoc. For reasons assigned this (consolidated) day in the case of Derouen v. Lard et al., La.App., 121 So.2d 311 , we affirm trial court in his maintenance of an exception ratione materiae, concerning alleged acts occurring prior to November 13, 1959, at plaintiff’s costs. Amended and affirmed.
