FORET, Judge. For reasons handed down this date in the companion case of Tolbert et al. v. Ryder et al., La. Third Circuit Court of Appeal, 345 So.2d 548 , the judgment of the trial court is affirmed with the amendment made in Tolbert. AMENDED AND AFFIRMED.
