MARCUS, Justice (concurring). I agree that the facts here are distinguishable from those in State v. Muller, 365 So.2d 464 (La.1978); however, I would overrule Muller as being an improper interpretation of La.R.S. 14:106. Accordingly, I respectfully concur.
