City of Shreveport v. Shaffer

In re Ernest W. Shaffer, Jr. applying for remedial writ. Caddo Parish. City Court of Shreveport. T-5319. Writ denied. Unlike the case on which relator relies, City of New Orleans v. Lyons, 342 So.2d 196 , the Shreveport ordinance under which relator was prosecuted is a “fighting words” breach of the peace statute. See Chaplinsky v. New Hampshire, 315 U.S. 568 , 62 S.Ct. 766 , 86 L.Ed. 1031 (1942) as reaffirmed in Gooding v. Wilson, 405 U.S. 518 , 92 S.Ct. 1103 , 31 L.Ed.2d 408 .
