DENNIS, Justice, dissenting. I respectfully dissent. The trial court correctly appointed Edward Koch, Jr. under its authority to appoint another succession representative “forthwith.” La.C.C.P. art. 3181. See the dissenting opinion of Judge Redmann in the court of appeal. 372 So.2d 741 (La.App. 4th Cir. 1979).
