Opinion text
TALIAFERRO, Judge (dissenting). Exceptions to the jurisdiction of a court ratione personae are classed by the Code of Practice as dilatory. Joinder of issue either by answer or default cuts off dilatory pleas. I believe the dissenting opinion of Justice Thompson, referred to in the majority opinion, correctly reflects the law on the question.
