DOMENGEAUX, Judge, concurring. I agree with the majority opinion here. I was the author of the second opinion, 357 So.2d 19 . Probably, counsel for Foret was misled by the gratuitous language on page 21 of the opinion which formed the last paragraph of Section I on Penalties and Attorney’s Fees. To the extent that that paragraph may have caused this new suit to be fruitlessly filed, I regret its inclusion in the opinion.
