PER CURIAM. For the reasons assigned on rehearing in Toney v. Whitfield, 531 So.2d 445 (La. 1988), decided this date, the judgment of the district court is reversed and the case is remanded to the district court for proceedings consistent with our opinion therein. CALOGERO, J., concurs.
