LEMMON, J., concurs in the denial, but notes that Jones v. Thibodeaux, 445 So.2d 44 (La.App. 4th Cir.1984), which was relied on by the Court of Appeal in this case, decided a different attack on the constitutionality of the statutory scheme. DIXON, C.J., and CALOGERO and DENNIS, JJ., would grant the writ.
