_JjBARRY, Judge, concurring with reasons. I concur because plaintiff expressly stated that it did not allege or attempt to prove fraud. Under Straus Frank Co. v. Brown, 246 La. 999 , 169 So.2d 77 (1964), fraud is required where plaintiff relies on the secondary meaning doctrine to support its requested injunction.
