THIBODEAUX, Judge. For the reasons discussed in the consolidated case of Brown v. Louisiana Indemnity Co., 96-1393 (La.App. 3 Cir. 4/23/97) ; 693 So.2d 270 , the judgment of the trial court is affirmed. Costs of the appeal are assessed to the State of Louisiana, Through the Department of Transportation and Development in the amount of $2,713.01. AFFIRMED.
