Bullard, J., delivered the opinion of the court. , . lms case cannot be distinguished from that of the same plaintiffs vs. Williams, decided at the present term; and for the reasons given in the opinion of the court therein pronounced, the same judgment must follow. It is, therefore, ordered, adjudged and decreed, that the judgment of the District Court be affirmed, with costs.
