This case was, by consent of parties, submitted without argument, with an-. *146 understanding that the judgment of tlie court below should be affirmed, tbe appellee waiving tbe damages by him prayed for, in his answer, as for a frivolous appeal. It is therefore ordered and decreed, that tbe judgment of tbe district court be affirmed, with costs.
