Meebiok, 0. J., concurring. The decree in this case produces a great hardship upon the plaintiff. It is with reluctance that I yield my assent, and only do so because compelled, as I conceive by the clear provisions of tbe law. I think tbe decree in tbe proceedings in monition was a final bar to all further claims on tbe part of tbe plaintiff.
